EELA-ERA Annual Seminar on Labour Law

Last Friday, 25/11/2022, I attended the Annual Seminar on EU Labour Law in Brusssels organized by ELLA and ERA. We were given an intense update on Algorithm management and the Proposed Work Directive; Enviromental, social and governance and the Commission proposal for a Directive on corporate due diligence; Directive on fair minimum wages; and a review on Recent CJEU case law on labour law matters.

On algorithm management, information asymetries pose a threat to employees health by continously monitoring activities. Also workers privacy maybe harmed by convenient but unnecessary collection of data. Finally, the automation of decision eliminates the human agency, making sometimes impossible for even the corporate structure to fully understand the reason of an actual decision. As for spanish employment jurisdiction, it is sufficiently protected on the 3 main aspects, due to health prevention and protection compliance obligations; internal case law on proportional uses of potentially invasive data collection; and burdens on explanation and proof of contractual breaches for sanctions in the workplace.
